In this interactive course, you will learn the skills required properly conduct and speedily conclude workplace investigations as well as navigate the legal, political and confidentiality considerations which arise in the investigative process in order to minimise risk.

• To investigate or not? Factors to consider when deciding whether to investigate

• Developing the investigation framework

Topic 2 – Conducting the investigation

• Gathering information
• Witness interviews
• The interview process
• The role of a union representative or support person during an interview
• Preparing records

Topic 3 – Making findings

• The standard of proof – “on the balance of probabilities”
• Weighing evidence
• Preparing an investigation report
• What happens after the investigation?

Topic 4 – Common Pitfalls

• Employee claims
• Remote interviews
• Refusal to sign off on witness statements
• Participant unavailable for interview
• Worker's compensation claims
• Union involvement
